[42 N.Y.2d 848 Page 849] Appeal, by permission of the Appellate Division of the Supreme Court in the Fourth Judicial Department, from an order of said court, entered July 12, 1976, which unanimously confirmed an order of the State Human Rights Appeal Board, affirming a determination of the State Division of Human Rights that appellant Jamestown Telephone Corporation (Jamestown) discriminated against the female complainants because of sex, and directing Jamestown to make monetary payments to complainants. The Appellate Division concluded that the record contained substantial evidence to support the division's findings that Jamestown discriminated against two of its female employees who became pregnant, by requiring them to quit two months before their expected delivery dates and not authorizing their early return to work after their delivery, by refusing to permit them to apply their sick leave credits to such absences, and by refusing to continue to pay premiums on their health insurance; that complainants were not required to exhaust their contractual remedies under the collective bargaining agreement before seeking relief through the division; that complainants complied with subdivision 4 of section 297 of the Executive Law, and that the division did not err as a matter of law in determining that Jamestown discriminated against complainants and in ordering Jamestown to make monetary payments to them.
